Privacy Policy

Box Jeannie Community Guidelines

 

Our guidelines were developed to help make every experience feel safe, respectful, and positive. They apply to everyone who

uses Box Jeannie’s platform, including but not limited to drivers, consumers, and businesses. It also includes interactions you may have with Box Jeannie employees and contractors, through online support systems, or over the phone. And, in some instances, our guidelines apply to conduct outside the Box Jeannie Marketplace Platform that we become aware of, including but not limited to information from other platforms, when such conduct may threaten the safety of the Box Jeannie Marketplace Platform.

Thank you for joining us in supporting and safeguarding a welcoming environment.

 

The guidelines below help explain some of the specific kinds of positive community engagement on the Box Jeannie Marketplace Platform, as well as the behaviors or circumstances that may cause you to lose access to the Box Jeannie Marketplace Platform. There will always be unforeseen events that may ultimately lead to your losing access to using the Box Jeannie Marketplace Platform and services, but the following guidelines—which we will update regularly—provide the basis for behavior we expect from all in the Box Jeannie community. Not following any one of our guidelines can constitute a material breach or violation of the terms of your agreement and may result in the loss of access to part or all of the Box Jeannie Marketplace Platform.

We update our guidelines regularly to address relevant behavior and risks. Our goal is to ensure that everybody in the Box Jeannie community always feels safe and welcome.

Please take a moment to read them.

 

Subscriptions

 

Business who subscribes to the 10 or 20 monthly subscription programs will have the option to use any of the Box Jeannie services for their allowance.  Each request will be subtracted against the total subscription allowance. Wishes that require over 20 miles or 6 plus packages will count as 2 wishes.

 

 

Box Jeannie Business Routes

Driver’s who sign up a business must utilize their referral code and identification code to ensure that they will receive “right of first refusal” which is a 20-minute head start.  This referral will tag the driver as the “route licensee”.  A driver should create a preferred route by signing up multiple businesses and individuals in an expedient geographic area to the subscription agreement, however any client referral will be included in the route licensing.  

 

Box Jeannie Route Referral Policy

 

Drivers who sign up a business or person must utilize their referral code and identification code to ensure that they will receive “right of first refusal” which is a 20-minute head start.  Referring driver will receive a notification of an available pickup from clients prior to the notice being sent to general public.  Driver will have 20 minutes to accept opportunity, if referral driver fails to timely accept the opportunity the notice will go out to the public.  A driver that abandoned the referral client for more than 6 months forfeits the right of first refusal and loses the 20-minute exclusivity on notification.  Abandoned is defined as failure to accept an opportunity from the referral client for six consecutive months.

 

Gin Master

 

A “Gin Master” must have 50 or more referrals to gain status as Gin Master and must maintain an active account.  

 

“Gin Master” defined as the driver who their referral code to have a household or business download the app thereby creating a route.  A Gin Master will have referred his/her code to enough clients to monetize a “licensed” route.   

 

Payment of Licensing fee:  A Gin Master’s route maybe be sold with the Gin Master receiving up to 50% of the proceeds, price of the route will be set at market going to the highest bidder, based upon the buyers licensing fee minus any expenses incurred due to the sale when applicable.    

 

 

All Gin Master routes will be maintained by Box Jeannie and can be sold at any time as long as a buyer provides funds. 

 

Abandonment: If a driver abandons the clients for 6 months, he/she forfeits the rights to the route.  Abandonment is defined as non-usage of the Box Jeannie App and/or a failure to provide a wish for consecutive 6 month period.

 

If a Gin Master violates Box Jeannie policies, they forfeit their the route licensing fee.

 

Box Jeannie, may for business reasons, sell an active in good standing “Gin Masters” route as long as it is to the highest bidder and the licensing fee is paid to the Gin Master.

 

Payment of the Licensing fee to the Gin Master will be made within 30 days of settlement of payment. 

 

Box Jeannie -Sending a Package

 

Anyone sending a package should have the package clearly identified for pick up with the package’s final location as well as all necessary return slips.  Any package not properly identified maybe delivered in error.

 

Time Zones and Unusual Request

All Master’s and business owners should aware that if their request is difficult to complete due to unusual physical location, the packages present unusual difficulty in delivering or at an extremely inconvenient times may not be executed.  

 

General Rules of Conduct

 

Treat everyone in the Box Jeannie community as you would like to be treated yourself: with respect. The actions you take while using the Box Jeannie Marketplace Platform can have a big impact on the safety and comfort of others. Courtesy matters. That’s why you are expected to exercise good judgment and behave decently toward other people when using the Box Jeannie Marketplace Platform and interacting with others in the Box Jeannie community—just as you would in any public place. This includes behavior toward the Box Jeannie information team.

 

Box Jeannie is an anti-racist company. We are committed to creating a safe and welcoming space for everyone, regardless of background. Remember that when you interact with others in the Box Jeannie community, you may meet people who may look different from you, think differently than you, or come from different backgrounds. Please respect those differences. Discrimination based on race, or any other characteristic protected by law will not be tolerated on the Box Jeannie Marketplace Platform and can result in loss of access to the apps. Additionally, if you witness discrimination taking place, you can report the situation to Box Jeannie, and we will address any report in accordance with our policies. 

 

We believe that everyone should feel supported and welcomed when interacting with others in the Box Jeannie community. That’s why we’ve created standards and policies on physical contact, sexual assault, and misconduct, threatening and rude behavior, post-trip contact, discrimination, and property damage.

Respect isn’t always tied to what you say; it is also about how you act. For example, always try to be on time for your ride or to pick up your delivery. It’s also common courtesy not to shout, swear, or slam doors. And by tidying up after yourself—whether it’s taking your trash home or cleaning up a spilled drink.

 

 

Physical contact

No one on the Box Jeannie Marketplace Platform should be touched without their consent, period. Don’t touch strangers or anyone you just met while using the Box Jeannie Marketplace Platform. Limited exceptions are permitted for people needing or requesting physical assistance

Sexual assault and misconduct

We all value our personal space and privacy. It’s OK to chat with other people while remaining respectful. But please don’t comment on someone’s appearance or ask whether they are single. Sexual assault and sexual misconduct of any kind is prohibited. Sexual assault and misconduct refer to sexual contact or behavior without explicit consent of the other person.

Personal space and privacy should be respected. The following list provides examples of inappropriate conduct but is not exhaustive.

• Do not ask personal questions (for example, about relationship status or sexual orientation)

• Do not comment on appearance (for example, derogatory or “complimentary” comments)

• Do not make explicit comments or gestures (for example, slurs, or graphic or suggestive messages)

• Do not flirt (for example, nonverbal, suggestive flirting, or being too physically close)

• Do not display indecent material (for example, sexually suggestive objects or pictures)

• Box Jeannie has a no-sex rule regardless of whether you know the person, or they give you their consent

Threatening and rude behavior

Aggressive, confrontational, or harassing behavior is not allowed. Don’t use language, make gestures, or take actions that could be disrespectful, discriminatory, threatening, or inappropriate. The following list provides examples of threatening or rude behavior but is not exhaustive.

• Do not share graphic images or other harmful content (such as those that are sexually explicit or depict violence) with others in the Box Jeannie community; this includes unsolicited sharing of such images through Box Jeannie’s online support systems or in connection with a Box Jeannie Marketplace Platform experience

• Stay away from personal topics that can potentially be divisive, like religion and political beliefs

• Do not make verbal or physical threats of violence toward anybody

• Do not use derogatory or discriminatory language, such as racist or prejudiced comments or slurs, for any reason

If you are the recipient of or witness to any threatening or rude behavior, you can report the situation to Box Jeannie, and we will address any report in accordance with our policies.

Post-trip contact

Contact should end when the delivery is complete unless it’s to return a lost item. Unwanted contact can be seen as harassment and includes, for example, texting, calling, social media contact, visiting, or trying to visit someone in person after a delivery has been completed. Do not share any unnecessary contact information.

 

 

Discrimination

You should always feel safe and welcome. That’s why we don’t tolerate racist or discriminatory conduct and behavior, including toward the Box Jeannie information team. We encourage you to engage in all interactions with empathy, inclusivity, and intent to provide an anti-racist, anti-discriminatory space for everyone. Do not discriminate against someone or engage in a disparaging manner toward someone based on traits such as their race, ethnicity, skin color, age, disability, gender identity, marital status, pregnancy, national origin, religion, sex, sexual orientation, language, geographical location, or any other characteristic protected under relevant law.

The following list provides examples of discriminatory behavior but is not exhaustive.

• Do not refuse to provide services based on characteristics like a person’s race, ethnicity, skin color, age, disability, gender identity, marital status, national origin, religion, sex, sexual orientation, language, geographical location, or any other characteristic protected under relevant law.

• Do not discriminate on the basis of a consumer’s drop off, return, or door to door delivery destination. We understand how important it is to fit driving or delivering around your life, rather than the other way around. It is not a violation of these guidelines to decline a trip or delivery because it does not work for you. But intentionally refusing or canceling requests, or using features on the Box Jeannie Marketplace Platform to avoid receiving trip or delivery requests, solely for the purpose of avoiding a particular neighborhood due to the characteristics of the people or businesses that are located in that area, is not allowed.

• Do not use discriminatory language, make discriminatory remarks, vilify, or ask questions about sensitive topics regarding national origin, race, ethnicity, or any other trait previously mentioned. Making racial comments or using slurs is never allowed.

 

We also want to help increase the transport options and delivery options for people with disabilities. That’s why we have information available for drivers, consumers, and businesses on this topic.

 

If you are subject to discrimination or witness discriminatory behavior, you can report the incident to Box Jeannie by reaching out to our Box Jeannie Information team at boxjeannieinformation@boxjeannie.com or by calling us at 732-962-7311. Call 911 for immediate assistance if you feel like your safety is in danger. Box Jeannie takes reports of discriminatory behavior very seriously. Any users found to have engaged in discriminatory behavior or used discriminatory language may lose access to the Box Jeannie Marketplace Platform.

 

Follow All Laws:

Everyone is responsible for knowing and obeying all applicable laws, including airport rules and regulations when at the airport, and the rules of the road—including complying with traffic laws, signs, and signals—at all times when using the Box Jeannie Marketplace Platform.

 

All relevant licenses, permits, and any other legal documents required of drivers and delivery people must be kept up to date. For example, all drivers using a vehicle are required by law to maintain a valid driver’s license, insurance, and vehicle registration. We review reports of crashes or traffic citations that may have happened during a trip or delivery, and other reports, including but not limited to those that may indicate poor, unsafe, or distracted driving. Local rules about parking may limit where drivers can park their vehicle when picking up orders or making deliveries. For example, stopping in bike lanes or blocking accessibility ramps may violate the law.

 

Box Jeannie takes reports of discriminatory behavior seriously. Any users found to have engaged in discriminatory behavior or used discriminatory language may lose access to the Box Jeannie Marketplace Platform.

Drugs and alcohol

Drug use and open containers of alcohol are never allowed while using the Box Jeannie Marketplace Platform. If you’re a driver, by law you cannot drive while intoxicated. The law prohibits driving while under the influence of alcohol, drugs, or any other substance that impairs your ability to safely operate a vehicle. 

Firearms ban

Drivers and delivery people are prohibited from carrying firearms while using the Box Jeannie Marketplace Platform, to the extent permitted by applicable law. 

 

Fraud

Deception can weaken trust and also be dangerous. Intentionally falsifying information or assuming someone else’s identity, for example when signing in or undergoing a security check, isn’t allowed. It is important to provide accurate information when reporting incidents, creating and accessing your Box Jeannie accounts, disputing charges or fees, and requesting credits. Only request fees or refunds that you’re entitled to, and use offers and promotions only as intended. Don’t knowingly complete invalid transactions.

Fraudulent activity may also include, but not be limited to: deliberately increasing the time or distance of a trip or delivery for fraudulent purposes or otherwise; accepting trip, order, or delivery requests without the intention to complete, including provoking riders or to cancel for fraudulent purposes; creating dummy accounts for fraudulent purposes; claiming fraudulent fees or charges, intentionally requesting, accepting, or completing fraudulent or falsified trips or deliveries; claiming to complete a delivery without ever picking up the delivery item; picking up a delivery item but retaining all or a portion of the item, and not delivering the entire order; actions intended to disrupt or manipulate the normal functioning of the Box Jeannie Marketplace Platform, including manipulating the settings on a phone to prevent the proper functioning of the platform and the GPS system; abusing promotions and/or not using them for their intended purpose; disputing charges for fraudulent or illegitimate reasons; creating improper duplicate accounts; or falsifying documents, records, or other data for fraudulent purposes.

Box Jeannie Candidate Privacy Notice

This notice describes how Box Jeannie and its affiliates/subsidiaries (collectively “Box Jeannie”) collect, use, disclose, and otherwise process the personal data (“Candidate Data”) of individuals who apply or are considered for a position with Box Jeannie (“Candidates”).

 

SCOPE AND APPLICATION

 

This notice governs Box Jeannie’s processing of Candidate Data anywhere in the world in connection with our recruitment of Candidates for positions at Box Jeannie.  This notice does not apply to Box Jeannie’s processing of personal data in connection with the use of its products or services. 

 

COLLECTION OF CANDIDATE DATA

 

We collect the following categories of Candidate Data directly from you:

• name, address, email address, telephone number, or other contact information

• resumes/CVs, cover letter, academic transcripts, and other statements of experience and education

• the position(s) for which you wish to be considered, desired salary, willingness to relocate, and other job preferences

• how you heard about the position

• prior employers, dates of employment, positions held and/or job titles

• referral names and contact information for referrals

• name and contact information for references (it being solely your responsibility to obtain consent from references before providing their personal data)

• any other personal data that you provide during the job search, application, or interview process with Box Jeannie, including medical/disability, information submitted in connection with skills assessments, additional information regarding work or educational experiences, information about employment offers from other companies, and reason(s) for acceptance/rejection

We may also receive the following categories of information from other sources:

• where permitted by law, background check data, potentially including your criminal history records.

• information concerning your prior employment, including (where permitted by applicable law) compensation and your educational and academic degrees, from employment agencies, publicly available sources, social media websites, former employers and/or educational institutions

• information provided by references that you provide

In addition, if you apply for a position in the United States, or in another country that permits such voluntary data collections, you will have the opportunity to provide information about your gender, race/ethnic origin and/or veteran status in order for us to conduct equal opportunity monitoring. Where permitted by law, we may also infer some of this information for past Candidates in order to improve our recruitment process. The provision of this information is entirely voluntary, and where required by law (including in the European Economic Area (“EEA”)), we only collect such information with your express consent. If you decline to provide this information, your application(s) will not be affected in any way. If you choose to provide this information, you consent to our using it for equal employment opportunity monitoring purposes. This information will be held and stored anonymously and will not be used to evaluate your application for employment.

 

USE OF CANDIDATE DATA

Box Jeannie uses your Candidate Data in connection with our Candidate recruitment process. For example, we use your Candidate Data to:

• evaluate and verify your education, skills, experiences and other qualifications and interests in connection with open roles at Box Jeannie

• communicate with you regarding the interview process, and inform you of potential career opportunities

• prepare offers of employment, including as it relates to compensation

• improve our recruitment process, including by generating anonymized data and analysis using Candidate Data

• perform pre-employment background checks where permitted by law

If you are hired as an outsider contractor, Box Jeannie will maintain your Candidate Data as part of your records.

If you are not hired for the position for which you were initially considered, we may use your Candidate Data to identify and contact you regarding other positions for which you may want to be considered. If you do not wish for Box Jeannie to use your data for this purpose, you may request that we delete your Candidate Data as explained below.

In addition, if you provide Box Jeannie with the contact information of your references, Box Jeannie may use that information to contact your references (and not for any other purpose). Information provided by such references will be used to evaluate your candidacy and will otherwise be treated in accordance with this notice.

SHARING OF CANDIDATE DATA

We may share your Candidate Data:

• with Box Jeannie subsidiaries and affiliates.

• with a Box Jeannie employee who has referred you to inform them about the status and outcome of the referral.

• with vendors, consultants, and other service providers who need access to such information to carry out work relating to the recruitment process on our behalf.

• in connection with, or during negotiations of, any merger, sale of Box Jeannie assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

• with law enforcement officials, government authorities, or other third parties if we believe it is required by applicable law, regulation, operating agreement, legal process such as subpoenas or court orders, or governmental request, if we believe your actions are inconsistent with our policies, or if we believe such sharing is necessary to protect the rights, property, or safety of Box Jeannie or others.

• in an aggregated and/or anonymized form which cannot reasonably be used to identify you.

Box Jeannie does not sell Candidate personal data.

 

COOKIES AND THIRD-PARTY TECHNOLOGIES

We may allow others to provide online audience measurement and analytics services for us, to serve advertisements on our behalf across the Internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, SDKs, and other technologies to identify your device when you visit our site, including information about these technologies and service providers, please refer to our Cookie Statement on page 19.

CANDIDATE DATA RETENTION AND DELETION

 

Box Jeannie retains your Candidate Data for as long as you are under consideration for a contract position with Box Jeannie. Thereafter, Box Jeannie retains your data in accordance with the laws in the countries where you live. These laws may require Box Jeannie to retain your information for periods defined in such laws, or to delete it after periods defined in those laws. Unless otherwise required by such laws, Box Jeannie will retain your Candidate Data for 3 years after it ceases to consider you for a position with Box Jeannie, and will thereafter delete your Candidate Data except for historical information regarding the positions for which you were considered (e.g., the position(s) for which you applied and the dates of your application(s)), and the decisions made by Box Jeannie with respect to your candidacy (which may include the grounds for the decision). In some cases, we may ask for your consent to retain your Candidate Data for longer than the period otherwise permitted under applicable laws.

You may also request deletion of your Candidate Data at any time. Unless otherwise required by law, or where Box Jeannie may have a legitimate interest that justifies continued retention, Box Jeannie will delete your Candidate Data after receiving such request, except for historical information regarding the positions for which you were considered, and the decisions made by Box Jeannie with respect to your candidacy.

 

YOUR RIGHTS

You have the following rights with respect to Box Jeannie's handling of your Candidate Data:

• access your personal data

• correct any errors regarding your personal data

• erase or delete your Candidate Data under the terms above

• object to or restrict certain processing of your Candidate Data

• receive your Candidate Data in a usable electronic format and transmit it (data portability)

• withdraw your consent to the processing of your Candidate Data

To exercise these rights, please make your request to our Box Jeannie Information team at boxjeannieinformation@boxjeannie.com or by calling 732-962-7311. Please note that in certain instances, exercising your rights to object to or restrict processing of your Candidate Data, or to withdraw consent relating to the processing of your Candidate Data, may impact our ability to consider you for a position with Box Jeannie. However, candidates will not be discriminated against for exercising these rights.

In addition, if you are a resident of the EEA, you also have the right to lodge a complaint with your local data protection authority or regulatory body relating to Box Jeannie’s handling of your Candidate Data.

Updates to the Notice

We may change this notice from time to time. Any changes to this notice go into effect upon the effective date of the revised notice.

 

Acceptable Box Size

 

When using Box Jeannie services to recycle empty boxes, return unwanted items, and deliver items door to door, the box must not weigh more than 50 pounds in order for our drivers to easily be able to transport scheduled items from starting point to final destination. The boxes must also be smaller than any commercial size boxes so that our drivers can easily fit each item into their car without having the item hinder their ability to drive. A commercial size box constitutes a box that is either 48” x 24” x 28” and up. Proper Handling Of Orders (Information for Merchants)

 

Merchants are expected to meet all relevant licensing requirements, give packages appropriate care as to dot damage them as well as us industry best practices policies. Merchants must maintain valid licenses and/or permits where required by law.

 

As Box Jeannie has a 4-to-6-hour pick and delivery window many items are not appropriate for delivery via our marketplace.  Foods are perishable and can cause illness if not properly handled. Such foods can be potentially hazardous if not maintained under the proper time and temperature controls prior to pick up and for duration of 4 to 6 hours.

To help ensure that food reaches users safely, merchants are encouraged to seal packages in tamper-evident packaging ahead of delivery. Merchants are expected to act responsibly on information provided by users related to food allergies, intolerances, or other dietary restrictions and reject order requests with which they cannot comply.

Box Jeannie takes no responsibility for spoiled or perishable food, fragile items or damaged items.  We recommend you evaluate every item to be delivered and ensure it is packed appropriately to avoid damage or spoilage.

 

Provide a safe space for pickups

Customer’s, Merchants, and their staff are expected to exercise good judgment and behavior around delivery people and make them feel welcome, just as they would with their in-person customers. They should also provide a safe area for order pickups; for example, merchants should work to prevent violent incidents on the merchant premises that might endanger delivery people’s safety. Discriminatory remarks or behavior by any user of the Box Jeannie Marketplace Platform is not tolerated.

Alcohol delivery

All orders that contain alcohol must comply with any applicable laws and restrictions on off-premises alcohol delivery and hours of service. Only Box Jeannie users who are the legal age to buy alcohol (21 in the US, and 18 or 19 in Canada) or older, and not intoxicated, can order and receive alcohol deliveries where such deliveries are available. Box Jeannie users will be asked to show government-issued photo IDs to verify age and identity when an alcohol delivery arrives. If the Box Jeannie user does not have a valid government-issued photo ID, or appears intoxicated, the alcohol portion of the order will not be able to be delivered and may be returned to the seller on the Box Jeannie user’s behalf and at the Box Jeannie's user's expense. Box Jeannie's users may not place an order that includes alcohol to be delivered to a public location where open containers are prohibited, or to any other areas where possession or consumption of alcohol is prohibited by law.

 

 

Delivery, Redelivery, and Undeliverable Packages

If the Service Provider is not able to complete the delivery because, for example, the Package Recipient is not at the delivery location to accept the delivery, the Service Provider may attempt to arrange for the return of the Package to you. You acknowledge and agree that you may be charged for any costs associated with a delivery failure or a return delivery.

If the Service Provider is not able to return the Package, you acknowledge and agree that the Package may be left at the original pickup location, with local law enforcement or, provided you send the Service Provider written instruction via the Technology Services, at the delivery location. To the extent feasible and if requested by you, Box Jeannie will also attempt to facilitate an exchange of the undelivered Package between you and the Service Provider. You acknowledge and agree that you may be charged additional fees in connection with the return, redelivery or disposal of your Package.

Lost or Stolen Packages

Box Jeannie is not responsible for lost or stolen packages, however if you believe a driver has stolen the package contact Box Jeannie Customer service. If you want to report it, you can contact our Box Jeannie information team at boxjeannieinformation@boxjeannie.com or at 732-962-7311 so that our Support team can follow up.

Package Notices

Driver’s will receive notices that there is an opportunity in their prescribed radius, unless notifications are disabled in their phone.  

 

The Package Sender will receive a notice that the Driver will is picking up and dropping off a Package via Box Jeannie app, and the message will provide them the opportunity to contact the Service Provider to arrange for Package delivery (the “Package Recipient Notice”).  Where a Package Recipient is arranging for a delivery of a package from a Package Sender via Box Jeannie, the Package Sender will receive a Package Sender Notice, which will provide them the opportunity to contact the Service Provider to arrange for Package pickup. (The Package Recipient Notice and the Package Sender Notice are referred to together as the “Package Notice”.)

For Package Notices going to existing Box Jeannie app users, the Package Notice may be a push notification, or an SMS message, depending on their app user preferences. 

 

For Package Senders or Package Recipients who are not existing Box Jeannie app users, the Package Notice may be an SMS message from Box Jeannie, which the Package Sender or Package Recipient receives, if applicable, pursuant to the following terms:

Box Jeannie Driver to complete delivery Policy

Driver’s will accept opportunities are required to complete said task and will   not be paid for partial service.  Any driver who accepts the opportunity and fails to cancel will be subject to removal from the Box Jeannie App.     

Box Jeannie Cancellation Policy

A user can cancel their scheduled order before or after the pickup has been accepted by the driver. However, in the case a user cancels the order after one hour of the driver accepting it, the user will be charged with a one-hour cancellation fee of 50% based on the size of the wish. Box Jeannie has put this policy in place as our drivers are taking the time that could be spent accepting other orders on your order which they have to plan accordingly for in regards to miles driven, how much gas they have, and what would be the best route to take to get to your pickup destination. If you feel you have been charged and your wish doesn’t fall under our cancellation fee policy, please contact our Box Jeannie Information team either through our website or by emailing us at boxjeannieinformation@boxjeannie.com

 

 

 

Refusal or Rejection of Deliveries

At a Service Provider’s sole discretion, a Service Provider may refuse to pick up or deliver the Package(s), or cancel the delivery after acceptance for any reason; provided at all times, Service Providers must comply with the Community Guidelines.

 

Your feedback matters

If something happens, whether it’s good or bad, we make it easy for you to tell us. Our team is continually improving our standards, and your feedback is important to keep our standards relevant as our technology evolves. Please rate your experience at the end of each delivery. Honest feedback helps ensure that everyone is accountable for their behavior. This accountability helps create a respectful, safe environment. And if something happens—such as a traffic accident—and you want to report it, you can contact our Box Jeannie information team at boxjeannieinformation@boxjeannie.com or at 732-962-7311 so that our Support team can follow up. In case of an emergency or if you find yourself in immediate danger, alert your local authorities or emergency services before notifying Box Jeannie.

 

 

How Box Jeannie enforces our guidelines

 

Losing access to the Box Jeannie Marketplace Platform may be disruptive to your life or to your business. That’s why we believe it is important to have clear standards that explain the circumstances in which you may lose access to the Box Jeannie Marketplace Platform. If you violate any terms of your contractual agreement with Box Jeannie, or any applicable terms or policies, including any one of these Community Guidelines or any additional policies and standards that are communicated by Box Jeannie to you from time to time, you can lose access to all or part of the Box Jeannie Marketplace Platform. If you have more than one Box Jeannie account, such as a Consumer account and a driver account, violating the Community Guidelines could also lead you to lose access to all Box Jeannie accounts. If you believe an error caused you to lose access to your account, you may contact the Box Jeannie information team.

Box Jeannie receives feedback through a variety of channels, reviews reports submitted to our Support team that may violate our Community Guidelines, andmay investigate through a specialized team. If we are made aware of potentially problematic behavior, we may contact you so we can look into it. We may, at our sole discretion, put a hold on your account or turn your account inactive until our review is complete.

 

Not following any one of our guidelines may result in the loss of access to all or part of the Box Jeannie Marketplace Platform. This can include reported violations of our Community Guidelines and certain actions you may take outside of the Box Jeannie Marketplace Platform, including but not limited to information from other platforms, if we determine that those actions threaten the safety of the Box Jeannie community, our employees, and contractors, or cause harm to Box Jeannie’s brand, reputation, or business. And if the issues raised are serious or a repeat report, or you refuse to cooperate, you may lose access to the Box Jeannie Marketplace Platform. Any behavior involving discrimination, violence, sexual misconduct, harassment, fraud, or deceptive, illegal, or unsafe activity, while using the Box Jeannie Marketplace Platform can result in the immediate loss of access to the Box Jeannie Marketplace Platform. 

Data retention and deletion

Box Jeannie retains user data for as long as necessary for the purposes described above.

Users may request deletion of their accounts at any time. Box Jeannie may retain user data after a deletion request due to legal or regulatory requirements or for reasons stated in this policy.

We and our affiliates, 3rd-parties, and other partners use cookies and other identification technologies on our websites, mobile applications, email communications, advertisements, and other online services (collectively, the ‘Services’) for a number of purposes, including: authenticating users, remembering user preferences and settings, determining the popularity of content, delivering and measuring the effectiveness of advertising campaigns, analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our Services. Cookies and Related Technologies Overview

Cookies are small text files that are stored on your browser or device by websites, apps, online media, and advertisements that are used to remember your browser or device during and across website visits. We also utilize other technologies that may identify you or the devices you use. For example, ‘pixel tags’ (also called beacons) are small blocks of code installed on (or called by) a web page, app, or advertisement which can retrieve certain information about your device and browser, including, for example: device type, operating system, browser type and version, website visited, time of visit, referring website, IP address, advertising identifiers, and other similar information, including the small text file (the cookie) that uniquely identifies the device. The primary app developer can install pieces of code (the SDK) from partners in the app, and thereby allow the partner to collect certain information about user interaction with the app and information about the user device and network information.

 

Advertising Synchronization & Relevancy

In order to facilitate the most relevant ads possible, Box Jeannie works with various service providers who assist us in delivering similar ads to end users across devices and platforms. For example, we work with social media advertising services to provide you with relevant ads based on your Box Jeannie activity through their media channels. We may also use service providers to provide you with a similar ad on a mobile website or mobile application as with a traditional website ad. See below for more information on your choices to limit these types of advertising.

Your Choices

You have the right to choose whether or not to accept cookies. However, they are an important part of how our Services work, so you should be aware that if you choose to refuse or remove cookies, this could affect the availability and functionality of the Services.

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. To do so, please follow the instructions provided by your browser which are usually located within the ‘Help’ or ‘Preferences’ menu. 

Some third parties also provide the ability to refuse their cookies directly by clicking on an opt-out link, and we have indicated where this is possible in the table below

IN ADDITION, BOX JEANNIE MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, OR AVAILABILITY OF THE DELIVERY MARKETPLACE OR ANY SERVICES OR GOODS REQUESTED THROUGH OR TRANSPORTED THROUGH THE USE OF THE DELIVERY MARKETPLACE, OR THAT THE DELIVERY MARKETPLACE WILL BE UNINTERRUPTED OR ERROR-FREE. LIMITATION OF LIABILITY

IN NO EVENT SHALL BOX JEANNIE’S AGGREGATE LIABILITY EXCEED $100 USD.

BOX JEANNIE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE DELIVERY MARKETPLACE, REGARDLESS OF THE NEGLIGENCE (EITHER ACTIVE, AFFIRMATIVE, SOLE, OR CONCURRENT) OF BOX JEANNIE, EVEN IF BOX JEANNIE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BOX JEANNIE SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE DELIVERY MARKETPLACE OR YOUR INABILITY TO ACCESS OR USE THE DELIVERY MARKETPLACE; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY SERVICE PROVIDER, EVEN IF BOX JEANNIE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BOX JEANNIE SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND BOX JEANNIE'S REASONABLE CONTROL.

 

YOU ASSUME EXPOSURE TO AND RISK OF ANY LOSS, THEFT, TAMPERING OR DELAY IN YOUR USE OF THE DELIVERY MARKETPLACE. BOX JEANNIE DOES NOT MAINTAIN INSURANCE FOR LOSS, DAMAGE, OR THEFT. YOU SHOULD CONTACT AN INSURANCE AGENT OR BROKER IF INSURANCE COVERAGE IS DESIRED. BOX JEANNIE DOES NOT PROVIDE INSURANCE COVERAGE.

THE DELIVERY MARKETPLACE MAY BE USED BY YOU TO REQUEST AND SCHEDULE DELIVERY SERVICES WITH INDEPENDENT THIRD-PARTY SERVICE PROVIDERS, BUT YOU AGREE THAT BOX JEANNIE HAS NO RESPONSIBILITY OR LIABILITY TO YOU RELATED TO ANY DELIVERY OR LOGISTICS SERVICES PROVIDED TO YOU BY SERVICE PROVIDERS OTHER THAN AS EXPRESSLY SET FORTH IN THESE CONNECT TERMS.

 

THE LIMITATIONS AND DISCLAIMER IN THIS SECTION DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, UBER’S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW. THIS PROVISION SHALL HAVE NO EFFECT ON BOX JEANNIE’S CHOICE OF LAW PROVISION SET FORTH BELOW.

 

 

 

Indemnity

You agree to indemnify and hold Box Jeannie and its affiliates and their officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees), arising out of or in connection with: (i) your use of the Delivery Marketplace or services or goods obtained through your use of the Delivery Marketplace, including, but not limited to, any harm caused by a Package(s); (ii) your breach or violation of any of these Connect Terms; (iii) Box Jeannie's use of your User Content; or (iv) your violation of the rights of any third party, including Service Providers.

Disputes and Arbitrator's Decision

All disputes are required to attend arbitration.  The Arbitrator will render an award within the time frame specified in the AAA Rules. Judgment on the arbitration award may be entered in any court having competent jurisdiction to do so. The Arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant’s individual claim. An Arbitrator’s decision shall be final and binding on all parties. An Arbitrator’s decision and judgment thereon shall have no precedential or collateral estoppel effect. If you prevail in arbitration, you will be entitled to an award of attorneys’ fees and expenses, to the extent provided under applicable law. Box Jeannie will not seek, and hereby waives all rights Box Jeannie may have under applicable law to recover attorneys’ fees and expenses if Box Jeannie prevails in arbitration.

 

  

Fees

 

Your responsibility to pay any AAA filing, administrative and arbitrator fees will be solely as set forth in the AAA Rules. However, if your claim for damages does not exceed $75,000, Box Jeannie will pay all such fees, unless the Arbitrator finds that either the substance of your claim or the relief sought in your Demand for Arbitration was frivolous or was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)).

Notwithstanding the provisions in Section 1 above, regarding consent to be bound by amendments to these Connect Terms, if Box Jeannie changes this Arbitration Agreement after the date you first agreed to the Connect Terms (or to any subsequent changes to the Connect Terms), you may reject any such change by providing Box Jeannie written notice of such rejection within 30 days of the date such change became effective, as indicated in the “Effective” date above. This written notice must be provided either (a) by mail or hand delivery to our registered agent for service of process, c/o Box Jeannie, LLC (the name and current contact information for the registered agent in each state are available online here), or (b) by email from the email address associated with your Account to: boxjeannieinformation@boxjeannie.com. In order to be effective, the notice must include your full name and clearly indicate your intent to reject changes to this Arbitration Agreement. By rejecting changes, you are agreeing that you will arbitrate any dispute between you and Box Jeannie in accordance with the provisions of this Arbitration Agreement as of the date you first agreed to the Connect Terms (or to any subsequent changes to the Connect Terms).

 

Severability and Survival

If any portion of this Arbitration Agreement is found to be unenforceable or unlawful for any reason, (1) the unenforceable or unlawful provision shall be severed from these Connect Terms; (2) severance of the unenforceable or unlawful provision shall have no impact whatsoever on the remainder of the Arbitration Agreement or the parties’ ability to compel arbitration of any remaining claims on an individual basis pursuant to the Arbitration Agreement; and (3) to the extent that any claims must therefore proceed on a class, collective, consolidated, or representative basis, such claims must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration.

Prohibited Items

You may use the Delivery Service to send any Prohibited Items (“Prohibited Items”). Prohibited Items include, but are not limited to:

• People;

• Illegal items;

• Firearms, weapons, ammunition, and their parts;

• Alcohol;

• Highly perishable food or beverages (e.g., raw meat or dairy products);

• Pharmaceutical products, over-the-counter medications, vitamins, or supplements;

• Recreational drugs, drug paraphernalia, or tobacco products;

• Money, gift cards, lottery tickets, or transferable securities; Dangerous or hazardous items, including explosives, items that are poisonous or flammable (e.g., paints or adhesives containing a flammable liquid), substances and material identified in the Hazardous Materials Table in 49 CFR section 172.101, or material determined to be hazardous under 49 U.S.C. section 5103 et. seq. 

• and transported in a quantity requiring placarding according to regulations prescribed under 49 CFR, Subtitle B, Chapter I, Subchapter C, hazardous waste (e.g., hypodermic needles), or medical waste;

• Stolen goods;

• Fragile items;

• Sexual aids; obscene or pornographic material;

• Livestock, regulated species (e.g., noxious weeds, prohibited seeds), or animal parts, bloods, or fluids; or

• Any items for which you do not have permission to send.

Additional Prohibited items

 

Merchants may only offer for sale items expressly contemplated under their agreement with Box Jeannie. Specially regulated or illicit items, such as cannabidiol (CBD) and tetrahydrocannabinol (THC) are not allowed to be offered on a merchant’s menu. Box Jeannie may remove from—or otherwise limit the merchant’s ability to post to—a merchant’s menu any items deemedprohibited or inappropriate.

Nor is any user permitted to ship items which are hazardous to the driver’s, community welfare or in violation of state or federal law.  

The above list of Prohibited Items is not exhaustive. Box Jeannie retains the discretion to prohibit additional items that are not on the above list. For a current list of Prohibited Items, please see here.

Package Restrictions

 

The Package(s), together, per trip, (i) may not be greater than 40 pounds, (ii) must fit comfortably in the trunk of a mid-size motor vehicle, and (iii) may not have a total value greater than $100 USD.

 

You must prepare and securely close and seal the Package(s) for safe delivery.
